These Terms & Conditions apply to the use of the Heron Farm website and to purchases, bookings and services provided by Heron Farm Devon Ltd (“Heron Farm”, “we”, “us” or “our”).

By using our website, placing an order or making a booking, you agree to these Terms & Conditions.


1. Website Orders

Product Availability

We aim to ensure that all products displayed on our website are available. Occasionally an item may become unavailable after an order has been placed. In this case we will contact you and offer a suitable alternative, refund or credit.

Prices

All prices are shown in pounds sterling (£) and include VAT where applicable. Prices are subject to change without notice.

Dispatch Times

We aim to dispatch orders within 5 working days. During busy periods, public holidays or adverse weather conditions, dispatch times may be longer.

We are not responsible for delays caused by third-party couriers.

Delivery Options

Delivery is charged at £9.99 on all orders under £95, and is free of charge for orders over £95. You can also select to collect from Heron Farm which is free of charge. You will be notified when your order is ready to collect. This will usually be within 7 working days.

Gift Voucher Terms

Gift vouchers may be used towards food, drink, experiences, accommodation or retail purchases at Heron Farm, unless otherwise stated.

Gift vouchers are valid for 12 months from the date of purchase and cannot be exchanged for cash. Any remaining balance after partial redemption will remain available until the voucher expiry date.

Vouchers may be redeemed over multiple visits unless otherwise specified.

Where a voucher is used to book an experience, tour, event or accommodation, normal cancellation policies for that booking will apply.

Lost, stolen or expired vouchers cannot be replaced or refunded.

Heron Farm reserves the right to refuse altered, damaged or fraudulent vouchers.

Returns and Refunds

If you change your mind about a non-perishable item, you may return it within 14 days of receipt for a refund, provided it is unused and in its original condition.

Customers are responsible for return postage costs unless the item is faulty or supplied incorrectly.

Perishable goods, food and drink products cannot normally be returned unless damaged or faulty.

If an item arrives damaged, please notify us within 48 hours of delivery and provide photographs where possible.

Refunds will be processed to the original payment method.


2. Event & Function Bookings

These terms apply to private functions, celebrations, corporate events and weddings held at Heron Farm.

Booking Confirmation

A booking is only confirmed once a signed agreement (where applicable) and any required deposit have been received.

Deposits

Deposits are non-refundable and non-transferable unless otherwise agreed in writing.

Final balances are due no later than 21 days before the event unless alternative payment terms have been agreed.

Guest Numbers

Final guest numbers must be confirmed no later than 21 days before the event and will form the basis for invoicing.

Any increase in numbers may be accommodated subject to availability. A reduction in numbers will not result in a revised price.

Cancellations

If a booking is cancelled:

  • More than 90 days before the event: deposit retained.
  • 30–90 days before the event: 50% of the estimated event value may be charged.
  • Less than 30 days before the event: up to 100% of the estimated event value may be charged.

We recommend that customers arrange suitable event insurance.

Use of Spaces

Guests must only use the areas agreed as part of their booking.

Heron Farm reserves the right to relocate events indoors or to alternative areas should weather, safety or operational considerations require it.

Conduct

We reserve the right to refuse service or ask guests to leave if behaviour is abusive, unsafe, illegal or causes disturbance to staff, other customers or neighbouring properties.

Decorations and Equipment

No naked flames, confetti, fireworks, sky lanterns or other hazardous materials may be used without prior written permission.

Nothing may be attached to walls, buildings or structures that could cause damage. Any breach of this policy will result in a damage fee being charged.

Closing Times

All events must conclude at the agreed time. Guests are expected to vacate the premises promptly at the end of the event. We expect guests to leave in a quiet and orderly fashion that is respectful of our close neighbours.

Liability

Heron Farm accepts no responsibility for loss, theft or damage to personal belongings or equipment brought onto the premises.


3. Restaurant Table Bookings

Reservations

Tables may be booked online, by telephone or in person.

We kindly ask guests to arrive on time. Tables may be released after 15 minutes if we have not heard from you.

Cancellations

We ask guests to notify us as soon as possible if they are unable to attend.

Repeated no-shows may result in future bookings requiring a deposit.

Deposits and Card Pre-Authorisation

For larger tables, special events, tasting dinners or other occasions, we may require:

  • A deposit per person; or
  • Card details to secure the booking.

Any deposit requirements will be clearly stated at the time of booking.

Where a card pre-authorisation is taken, a charge may be made in the event of:

  • Failure to attend the reservation;
  • Cancellation outside the stated cancellation period; or
  • Significant reduction in party size without notice.

The amount and cancellation period applicable to each booking will be communicated at the time of reservation.

Allergies and Dietary Requirements

Please inform us of any allergies or dietary requirements before ordering.

Whilst we take great care in food preparation, our kitchens handle allergens including nuts, gluten, dairy, eggs and shellfish and we cannot guarantee the complete absence of traces.

Children

Children must remain under the supervision of a responsible adult at all times.

Dogs

Well-behaved dogs are welcome in designated areas and must remain under control throughout their visit.


4. Experiences and Ticketed Events

Tickets for vineyard tours, tastings and special events are non-refundable unless the event is cancelled by Heron Farm.

Bookings may be transferred to another person if agreed in advance.

Heron Farm reserves the right to amend timings, menus, speakers or programme details where necessary.


5. Vineyard Tours and Experiences

These terms apply to vineyard tours, tastings, workshops, supper clubs and other experiences hosted by Heron Farm.

Bookings and Tickets

Bookings are subject to availability and are only confirmed once payment has been received.

Tickets and experience bookings are non-refundable unless an event is cancelled by Heron Farm. Subject to availability, bookings may be transferred to another date or person at our discretion.

Changes and Cancellation by Heron Farm

Heron Farm reserves the right to alter or cancel tours, tastings and events due to severe weather, safety concerns, low attendance, staff illness or other circumstances beyond our reasonable control.

In the event that Heron Farm cancels an experience, customers will be offered either a transfer to an alternative date or a full refund.

Participation and Safety

Guests participate in tours and experiences at their own risk.

Heron Farm is a working farm and vineyard and some activities involve walking on uneven ground, gravel paths, grass and sloping terrain. Visitors are advised to wear suitable footwear and clothing appropriate to the weather conditions.

Guests must follow any instructions given by Heron Farm staff at all times. Heron Farm reserves the right to refuse participation or ask guests to leave if their behaviour is considered unsafe, disruptive or likely to affect the enjoyment of others.

Alcohol Consumption

Alcohol will only be served to guests aged 18 years or over.

Heron Farm operates a Challenge 25 policy and reserves the right to request proof of age. Acceptable forms of identification include a valid passport, driving licence or PASS-approved proof of age card.

We reserve the right to refuse the sale or service of alcohol to anyone who appears intoxicated or whose behaviour is deemed inappropriate.

Dietary Requirements and Allergies

Where food is included as part of an experience, guests are asked to notify us of any allergies or dietary requirements in advance.

Whilst every effort is made to accommodate dietary requirements, food is prepared in kitchens handling allergens including nuts, gluten, dairy, eggs and shellfish, and therefore we cannot guarantee the complete absence of allergens.

Dogs

Well-behaved dogs are welcome at selected outdoor experiences, unless otherwise stated. Dogs must remain under control and on a lead at all times. Owners are responsible for their dogs and for cleaning up after them.

Photography

From time to time photographs and video footage may be taken during tours and experiences for use in marketing and promotional materials. Guests who do not wish to appear in photographs should inform a member of staff on arrival.

Liability

Nothing in these terms excludes liability where it cannot legally be excluded.

To the fullest extent permitted by law, Heron Farm shall not be liable for any loss, injury or damage suffered by guests arising from participation in tours and experiences, except where such loss or injury is caused by our negligence.

Personal belongings remain the responsibility of their owner and Heron Farm accepts no liability for loss, theft or damage to personal possessions.


6. Photography and Marketing

From time to time, photographs and video footage may be taken at public events, tastings and experiences for promotional and marketing purposes.

By attending public events, guests acknowledge that images or recordings may be used by Heron Farm in printed materials, social media, advertising and on our website.

Guests who do not wish to appear in photographs or recordings should notify a member of staff on arrival and we will make reasonable efforts to accommodate their request.

Professional photography or filming for commercial purposes is not permitted without prior written consent from Heron Farm.


7. Electric Vehicle Chargers

Electric vehicle charging facilities located at Heron Farm are owned and operated by InstaVolt.

Heron Farm accepts no responsibility for the operation, maintenance, pricing, availability or any interruption to charging services.

Any issues relating to charging, payments or faults should be directed to InstaVolt using the contact details provided on the charging units.

Heron Farm shall not be liable for any loss, damage or inconvenience arising from the use or unavailability of the charging facilities.


8 . Farm and Playground Safety

Heron Farm is a working farm and vineyard. Guests are asked to take care at all times and follow any instructions provided by staff.

Children must be supervised by a responsible adult at all times, including within the playground and outdoor areas.

Guests should be aware that uneven ground, changes in weather, farming activities, wildlife and agricultural equipment may present hazards.

Climbing on fences, walls, machinery or entering restricted areas is prohibited.

Use of the playground is entirely at the user’s own risk. Whilst we undertake regular inspections and maintenance, Heron Farm accepts no responsibility for accidents, injuries or damage arising from misuse of the equipment or failure to supervise children appropriately.

Visitors are requested to behave responsibly and to respect the safety and enjoyment of other guests.

Dogs are welcome in designated areas but must remain under control and on a lead where requested. Owners are responsible for cleaning up after their dogs and ensuring they do not disturb livestock, wildlife or other visitors.

Heron Farm accepts no responsibility for loss of or damage to personal property brought onto the premises.


9. Force Majeure

Heron Farm shall not be liable for failure to perform its obligations where circumstances beyond our reasonable control prevent us from doing so, including severe weather, flood, fire, pandemic, power failure, supplier issues or government restrictions.


10. Our Liability

Nothing in these Terms excludes liability where it cannot legally be excluded.

To the maximum extent permitted by law, our liability shall be limited to the value of the goods or services purchased.


11. Governing Law

These Terms & Conditions are governed by the laws of England and Wales and any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
